§ 1 General, scope of application of the GTC

§ These General Terms and Conditions of Sale and Delivery (hereinafter referred to as "GTC") apply to all orders placed on the online portal shop.niederegger.de for the delivery of the goods offered there.

§ 1.3 All deliveries and services are provided exclusively on the basis of these GTC in the version valid at the time of the order.

§ The delivery area comprises the Federal Republic of Germany and all other countries of the European Union.

§ 2 Conclusion of contract, realisation of the contract

§ The presentation of our range of goods on this website does not constitute a legal offer to sell.

§ 2.2 By submitting an order by confirming the "Order with costs" button, you submit a binding offer to us to conclude a purchase contract for the ordered goods. The contract is concluded when we accept your order with our order confirmation. You will receive this by email.

§ The acceptance of an order is subject to the condition that you have filled out the order form completely and correctly and have reached the age of 18.

§ 2.4 Orders are only accepted for normal household quantities.

§ Your order and the order data you enter will be saved in your personal customer account. You can access your customer account at any time using your login details.

§ If you have made a purchase of goods and services from us, we are entitled to send you information about our own similar goods and services via the e-mail address used for the purchase (Section 7 (3) UWG). You can object to this use at any time.

Your contact details will not be passed on to third parties for advertising purposes.

§ 3 Prices and shipping costs

§ All prices listed on the website are final prices in euros and include VAT at the applicable rate.

##########_15__ A flat-rate shipping fee of 6.99 euros is charged per order within Germany. In summer temperatures, the goods are shipped in refrigerated packaging, for which a flat-rate shipping fee of 9.90 euros is charged.

§ 4 Payment

§ Payment can be made via PayPal, paydirekt, credit card (Mastercard or Visa) or on account. Purchase on account is possible from €5 up to a maximum of €12,000 throughout Germany.

§ Outside Germany, payment is only possible by credit card, paydirekt and PayPal.

§ If you make justified use of your right of cancellation, we need your bank details in the case of the "credit card" payment method.

§ 5 Delivery / Retention of title

§ Delivery shall take place as soon as the goods have been paid for in full.

§ The obligation to deliver shall not apply if we ourselves are not supplied correctly and on time and are not responsible for this. In the event of non-availability, we will inform you immediately and any advance payments made will be refunded.

§ 5.3 We retain ownership until full payment has been made.

§ 6 Warranty / Liability

The warranty is based on the statutory provisions. We are not liable for damage that has not occurred to the goods themselves, except in the following cases:

  • Intent or gross negligence

  • personal injury

  • absence of warranted characteristics

  • Claims arising from the Product Liability Act

§ 6.1 You are solely responsible for the content of works (e.g. images, texts) submitted to the Niederegger Editor. You may not infringe the rights of third parties.

§ 7 Online dispute resolution

office direkt Service-Center GmbH declares its willingness to participate in consumer arbitration proceedings in accordance with the Consumer Dispute Resolution Act (VSBG) in the event of legal conflicts with consumers (§ 13 BGB).

§ 8 Consent to the transfer of data to the manufacturer

By agreeing to these GTC, you also consent to us transferring your contact details to the manufacturer _J.G. Niederegger GmbH & Co KG in order to inform you about its product range in the future. You can revoke this consent at any time.

§ 9 Bonus point system

1. eligibility to participate
The bonus point system is aimed exclusively at end consumers. Participation by commercial customers is excluded.

2. awarding of points
a) The customer receives 1 bonus point for every euro of goods value of the order.
b) 10 bonus points are credited for a one-off registration for the newsletter.
c) Bonus points are awarded at the sole discretion of the operator. There is no entitlement to a specific number of points. Points can be adjusted or cancelled by us at any time.

3. redemption of points
a) Bonus points can be redeemed in part or in full when making a purchase.
b) The value of the bonus points is to be determined by us and can be changed at any time. There is no legal entitlement to payment or a specific equivalent value.

4. deduction of points
a) Points awarded for cancelled orders, returns or partial returns will be deducted.
b) Points used for an order that is cancelled or returned will also be deducted.

5 Expiry of points
Bonus points expire automatically 365 days after they have been credited, unless they have been redeemed beforehand.

6. no legal claims
The bonus point system does not establish any entitlement to specific services, redemption or cash payment. The operator is authorised to change, suspend or terminate the system at any time.

7. miscellaneous
The bonus point system is non-transferable and cannot be combined with other customer accounts.

§ 10 Final provisions

§ The law of the Federal Republic of Germany shall apply to contractual relationships. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

§ 10.2 Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
